By checking the box to agree to the Proximo Candidate and Private Policy (this "Policy"), you agree that you have read and understand the following:
1. Proximo and Permission to Contact

Proximo Careers, LLC and its employees, independent contractors, and other affiliates (collectively "Proximo") operates a professional referral service that prescreens and refers candidates who are current or former professional athletes that sign-up on Proximo’s website (each an "Athlete" and collectively "Athletes") to employers and education providers (collectively "Clients").
2. Permission to Contact

By entering information on Proximo's website, Athletes give Proximo permission to contact them to discuss employment and further education opportunities using the information the Athlete provided and other information available to Proximo.

Athletes agree to comply with this Policy in consideration for receiving possible education and employment opportunities that may arise through works completed by Proximo.
3. Privacy:

Proximo will not knowingly or intentionally sell or share an Athlete's information with any persons or entities that are not Clients without the Athlete's permission or without notifying the Athlete.

Proximo understands and appreciates that, as recognizable persons in the sporting world, the privacy of Athlete information is paramount. Accordingly, Proximo will take reasonable steps to protect each Athletes' information, including password-protecting any data provided to it. Athletes agree to release from liability and waive all claims against Proximo for any damages, actual or consequential, that may arise from any third-party breaches of Athletes' data.

Proximo will not use an Athlete's name, image, or likeness without their approval.

At any time, Athletes may request, in writing, a copy of all their information held by Proximo.

The terms of this Section 3 shall survive the termination of any relationship between the Athlete and Proximo.
4. No Fees to be Paid to Proximo by Athletes:

Athletes will never be asked to make a payment to Proximo.

If Athletes are contacted by anyone requesting payment to be made to them in relation to their relationship with Proximo, Athletes shall not make any payment and shall immediately inform Proximo so that Proximo can report address this fraudulent behavior.
5. Services Provided

Proximo will review an Athlete's application and, if appropriate, will schedule an interview with the Athlete for screening purposes. Proximo will decide in its sole discretion whether an Athlete is suitable for placement with potential Clients based on the provided information, including the Athlete's background, interests, skills, and location preferences, if any.

If required, Proximo may also conduct prescreening, including a reference check, past employment verification, and any other verifications specified or required by a Client evaluating the candidacy of an Athlete.

Proximo reserves the right, in its sole discretion, to refuse its services to any Athlete at any time for any or no reason.
6. Athlete / Candidate Responsibilities

Athletes shall provide accurate and necessary information for Proximo to conduct background prescreening.

Athletes acknowledge that listed references may be contacted by Proximo or its Clients.

At all times, Athletes agree to act courteously and professionally when engaging with Clients, including being responsive, timely, and honest in all interactions.
7. No Guarantee Policy

Proximo is not bound to find an Athlete any employment or further education opportunities with its Clients and shall not be held liable for any failure to do so.
8. Miscellaneous

The Success Stories listed on this website do not guarantee or indicate a likelihood of Athlete success in finding a similar career.

The current roles of former professional athletes listed on Proximo’s website as ‘Success Stories’ may or may not have received their current employment roles directly through Proximo.

Pursuant to legal ethics rules, Proximo does not provide any legal advice or legal services and the relationship between the Athlete and Proximo shall not be construed to create any kind of client-lawyer relationship.

The relationship between an Athlete and Proximo shall not be construed as interfering with any existing athlete-agent contract in which the Athlete is currently or has been engaged. If an Athlete has an agreement with an athlete-agent related to their sporting activity, the Athlete should consult the agreement and seek professional legal advice regarding any employment activities that may be limited by the terms of the agreement.

The relationship between the Athlete and Proximo shall not be construed as interfering with any existing employment contract in which the Athlete is currently or has been engaged. If an Athlete has an employment contract or is still bound to the terms of a prior employment contract, the Athlete should consult such contracts and seek professional legal advice regarding any employment activities that may be limited by the terms of the agreement.

Athletes acknowledge, represent, and warrant that they have either (i) sought and received independent legal counsel regarding this Policy’s provisions or (ii) hereby waive the opportunity to seek independent legal counsel regarding the provisions contained herein.

This Policy shall be construed without regard to any presumption or rule requiring construction or interpretation against the party drafting an instrument or causing any instrument to be drafted.

Section headings in this Policy are inserted for ease of reference only and shall not affect construction.

If any provision of this Policy shall be held or made invalid by a court decision, statute or rule, or shall be otherwise rendered invalid, the remainder of this Agreement shall not be affected thereby.
